Thank you for using our products and services.  The Services are provided by Dr V Medical Systems, located in South Texas, United States.

By using our Services, you are agreeing to these terms.  Please read them carefully.

Using our Services

Do not misuse our Services; for example, do not try to access them using a method other than the interface and instructions that we provide.

Using our Services does not give you ownership of any intellectual property rights in our Services or the content that you access.  By entering the name of a registered party and entering the password as given creates a legal agreement between you (either an individual or an entity) and Dr V Medical Systems. By installing thes software package (if appropriate) and/or by using the SOFTWARE, you agree to be bound by the terms of this AGREEMENT, promptly return any disk package or agree to destroy the executable, accompanying items for a full refund during the warranty period..

Your DRVMedSys Account

You need a DRVMedSys Account in order to use, purchase, or download our Services.  Browsing does not require password or user name. You create your own DRVMedSys Account at the time you decide to purchase any of the products and services provided to you.

To protect your DRVMedSys Account, keep your password confidential.  Try not to reuse your DRVMedSys Account password on third-party applications.  If you learn of any unauthorized use of your password or DRVMedSys Account, contact us immediately.

About Software in our Services

GRANT OF LICENSE: This License Agreement (License) permits you to use one copy of the software product identified above, which may include user documentation provided in online or electronic form (SOFTWARE). The SOFTWARE is licensed as a single product, to an individual user. This Agreement requires that each user of the SOFTWARE be licensed individually.  The software is in use on a computer when it is loaded into the temporary memory (i.e. RAM) or installed on a network provided that appropriate restrictions are in place limiting the use to registered users only.

COPYRIGHT: The SOFTWARE is owned by DRV Medical Systems and is protected by United States of America copyright laws and international treaty provisions. You may copy the printed materials accompanying the SOFTWARE (if any), provided that is complete and proper credit is given to ownership,   nor copies with subsequent modification is permitted of any user documentation provided in online or electronic form. You must not redistribute the registration codes provided, either one paper, electronically, or stored in the program files, or any other form.

OTHER RESTRICTIONS: The registration notification provided, showing your authorization code and this License is your proof of license to exercise the rights granted herein and must be retained by you. You may not rent or lease the SOFTWARE, but you may transfer your rights under the License on a permanent basis, provided you transfer this License, the SOFTWARE and all accompanying printed materials, retain no copies, and the recipient agrees to the terms of this License and you notify DRVMedSys to extend the warranty to new user. You may not reverse engineer, decompile, or disassemble the SOFTWARE, except to the extent the foregoing restriction is expressly prohibited by applicable law.

Our Warranties and Disclaimers

DRV Medical Systems warrants that the SOFTWARE will perform substantially in accordance with the accompanying printed material (if any) and online documentation for a period of the purchase year, any DATA may have misspelling or incorrection that we strivre to eliminate but will edit if known to us.

CUSTOMER REMEDIES: DRV Medical System’s entire liability and your exclusive remedy shall be, at DRVMedSys's option, either return of the price paid or replacement of the SOFTWARE that does not meet this Limited Warranty and that is returned DRVMedSys with a copy of your receipt. This Limited Warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE will be warranted for the remainder of the original warranty period.

NO OTHER WARRANTIES: To the maximum extent permitted by applicable law, DRVMedSys disclaims all other warranties, expressed, implied including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the SOFTWARE and any accompanying written materials.

Liability for our Services

When permitted by law, DRVMedSys will not be responsible for lost profits, revenues or data, financial losses or indirect, special, consequential exemplary or punitive damages from the use of the software..

To the extent permitted by law, the total liability of DRVMedSys for any clams under these terms, including for any implied warranties, is limited to the amount that you paid us to use the Services (or, if we choose, to supplying you with the replacement or updated software product).

Business uses of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify DRVMedSys and its affiliates, officers, agents and employees from any claim, action or proceedings arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, judgments, litigation costs and legal fees.

About these Terms

We may modify these terms or any additional terms that apply to a Service.  We will post notice of modifications to these terms on this page. 

These terms govern the relationship between DRVMedSys and you.  They do not create any third party beneficiary rights.  If there is any part of this that you disagree with it is best that you do not continue use of product and service beyond the trial period.
